JUDGMENT : 1. The present bail application has been filed under Section 439 Cr.P.C. on behalf of the petitioner, who is in judicial custody in connection with F.I.R. No. 133/2018, Police Station Jalore Kotwali, District Jalore, for the offence under Sections 302/34, 302/120-B IPC. 2. Learned counsel for the petitioner submits that the petitioner is not named in the FIR and the co-accused Ajay @ Vijay has been granted bail by this Court. The case of the accused petitioner is also similar to that of to co-accused. 15 prosecution witnesses have been examined and not a single word has been alleged against the accused petitioner. 3. Learned Public Prosecutor has opposed the bail application. 4. Heard and considered the arguments advanced by the learned counsel for the petitioner and learned Public Prosecutor. 5. Having regard to the facts and circumstances of the case, this Court is of the opinion that the bail application filed by the petitioner deserves to be accepted. 6. Consequently, the bail application is allowed. It is ordered that the accused-petitioner- Gajendra @ Rahul S/o Narpat arrested in connection with F.I.R. No. 133/2018 shall be released on bail; provided he furnishes a personal bond of Rs. 50,000/- and two surety bonds of Rs. 25,000/- each to the satisfaction of the learned trial court with the stipulation to appear before that Court on all dates of hearing and as and when called upon to do so.
