ABHINAVA UPADHYA

body2019
JUDGMENT : Abhinava Upadhya, J. 1. The petitioner claims regularisation as lecturer on the basis of being treated as ad hoc employee under the U.P. Regularisation of ad hoc appointment (on posts within the purview of the Public Service Commission) Rules, 1979. It is submitted that pursuant to a judgment of this Court and a Government order dated 1.4.2004 such teachers who were kept on lecture basis were treated to be ad hoc employees under the aforesaid Rules of 1979. The said rules provides for regularisation of employees, as such the petitioner being fully qualified for regularisation made application before the Director for regularisation but no decision has been taken. 2. It appears from the letter of the Director dated 15.2.2008 filed as Annexure-10 that the Director has stated that the matter is pending before the Government. It is not disputed that the Director is the competent authority to grant regularisation. 3. The writ petition is disposed of with the direction that in case the petitioner possesses the eligibility criterion for regularisation, his claim be considered and appropriate order be passed as far as possible within a period of two months from the date of filing of a certified copy of this order.
