JUDGMENT : TARLOK SINGH CHAUHAN, J. 1. Issue notice. Mr. Vir Bahadur Verma, learned Central Government Counsel, appears and waives service of notice on behalf of the respondent. 2. The petition has been filed seeking therein the following reliefs:- (I) That the respondent may be directed to correct the date of birth of the petitioner in the passport as 13.3.1992 instead of 13.6.1992. (II) That the respondent may be directed to re-issue the passport to the petitioner, reflecting corrected date of birth of the petitioner i.e. 13.3.1992, as per the certificates issued by statutory authorities. (III) That the respondent may be directed to decide the representation (Annexure P-9) of the petitioner in a time bound manner." 3. The question raised in the instant petition relates to the correction of date of birth of the petitioner in the passport issued to her by the respondent. 4. The contemporaneous official records accompanying the petition unequivocally and clearly establishes and proves that the date of birth of the petitioner is 13.03.1992 and not any other date, more particularly 13.06.1992. This is clearly borne out from the Matriculation Certificate, 'Aadhar Card', PAN Card etc. 5. Thus, it is clear that the error in recording the date of birth of the petitioner is on account of some mistake or oversight of the respondent or else the date of birth of the petitioner could not have been recorded as 13.06.1992 instead of 13.03.1992. 6. In this view of the matter, the petition is allowed and the respondent is directed to correct the date of birth of the petitioner in the passport as 13.03.1992 instead of 13.06.1992. The respondent is further directed to re-issue the passport to the petitioner reflecting therein the correct date of birth. This exercise be done by the respondent as expeditiously as possible and in no event later than 26th February, 2019. 7. The petition is allowed in the aforesaid terms, leaving the parties to bear their own costs. All pending applications stand disposed of.
