JUDGMENT Mr. Anil Kshetarpal, J. (Oral):- Prayer in the petition is to grant regular bail to the petitioner in FIR No.232 dated 07.10.2018 registered under Sections 21, 61 of the Narcotic Drugs and Psychotropic Substances Act, 1985 at Police Station Sadar Ambala, District Ambala. 2. Learned counsel appearing on behalf of the petitioner contends that there is no other case under NDPS Act against the petitioner and the recovery from the petitioner is alleged to be of 15 injections of Buprenorphine 2 ml each. He further submits that investigation is complete. Challan has been presented and co-accused has been granted bail. 3. On the other hand, learned counsel for the State, on instructions from HC Rajesh Kumar, P.S. Sadar Ambala, and while filing custody certificate, has submitted that the recovery from the petitioner falls in commercial category. 4. Without commenting on the merits of the case and keeping in view the custody of the petitioner which is 7 months and 21 days and coaccused having been released on regular bail, the petitioner is directed to be released on bail on his furnishing bail bonds/surety bonds to the satisfaction of the concerned trial Court/Duty Magistrate. 5. Accordingly, the present petition is allowed.
