JUDGMENT 1. This writ petition has been filed under Article 227 of the Constitution of India for issuance of direction upon the respondent to disconnect the Electricity supply provided under the Consumer No. 170-UV-3577 in Panchayati Tower, Harmu Road, Ranchi. 2. The grievance of the petitioner is that the said premises is alloted by him in favour of one lessee namely Aroop Chatarzee who is making default in depositing the dues, pertaining to the consumption of electricity being provided under the aforesaid Consumer Number and therefore he cannot escape his liability. 3. Mr. Naveen Kumar learned counsel for the respondent submits that the electricity connection has been provided in the name of the petitioner and therefore liability is upon him to make payment of the electricity dues and if he has Subletted the premises it is in between petitioner and lessee and the respondent is in no way concerned. 4. Learned counsel for the petitioner in response submitted that he is not shifting from his liability but when the lessee is not making payment therefore he is requesting to the authority to disconnect the electricity line to avoid his future complication. 5. Having heard the learned counsel for the parties this court thinks it proper to remit the matter before the Electrical Executive Engineer, Jharkhand State Electricity Board, Kanke, Kanke Road, Ranchi who shall take decision in accordance with law within four weeks from the date of receipt of copy of this order which shall be presented by the petitioner before him within one week from the date of its receipt. 6. This writ petition is, accordingly, disposed of.
