JUDGMENT & ORDER : VIVEK KUMAR BIRLA, J. 1. Heard learned counsel for the petitioner as well as Sri Nand Lal Maurya, learned Standing Counsel appearing for the State respondents and Sri Ram Babu Yadav, learned counsel for the respondent no. 5 and perused the record. 2. With the consent of the parties, the writ petition is disposed of at the admission stage. 3. Present petition has been filed with a prayer to direct the respondents to remove illegal encroachment made on Gaon Sabha pond and Nali of Village Bela district Bhadohi over Araji no. 20Ga, 238Ga having area 1.4470 Hectare, 5.1530 Hectare respectively and Nali of Araji no. 131 having area 0.0730 Hectare within a specified period by completing proceedings of Case No. T201816670501150, T201816670501171, 201816670501153 and T201816670501154. 4. Pursuant to the order dated 8.1.2019 learned Standing Counsel has produced a copy of the instructions, which is taken on record. According to the instructions proceedings under Section 67 of the U.P. Revenue Code, 2006 are pending wherein next date fixed is 7.2.2019. 5. In view of the aforesaid, it would serve no purpose to keep the writ petition pending, and therefore, it is directed that the Assistant Collector shall pass appropriate orders within a period of three months from the date of production of a certified copy of this order. In case the allegations of the petitioner are found to be true the Assistant Collector shall ensure that the encroachments over the Gaon Sabha land are removed within a period of one month thereafter unless the order of Assistant Collector is stayed by any superior authority or court in any appeal or revision filed against the order of Assistant Collector. 6. It is clarified that this Court has not adjudicated upon the merits of the claim as raised by the petitioner in the present writ petition. 7. With the aforesaid directions, the writ petition is disposed of.
