JUDGMENT Dharam Chand Chaudhary, J. - In this writ petition, a direction is sought to be issued to the respondents-Corporation to release the retiral benefits, i.e. gratuity and leave encashment to the petitioner together with interest @ 9% per annum. As a matter of fact, the point in issue in this writ petition is no more res integra except for pensionary benefits as covered by the judgment of this Court in CWP No. 3050 of 2014, titled Nek Ram versus State of Himachal Pradesh and others, decided on 17.7.2014 except for pensionary benefits, which is not available to the employees in the respondentcorporation. 2. Learned standing counsel representing the respondent-corporation did not dispute the liability of the Corporation to pay gratuity and leave encashment which is Rs.5,77,730/- and Rs.3,13,081/- as per the documents Annexures P-1 and P-2 (colly). 3. The writ petition, as such, is disposed of with a direction to the respondents-corporation to release the amount of Rs.5,77,730/- and Rs.3,13,081/- towards gratuity and leave encashment in favour of the petitioner within four weeks from today together with statutory interest, if any, payable to the petitioner be, therefore, worked out within four weeks and the amount, if any, paid to him within the same time, failing which, together with interest @6% till the amount in question is actually paid. 3. pending application(s), if any, shall also stand disposed of.
