JUDGMENT Anubha Rawat Choudhary, J. - Heard counsel for the parties. 2. This application is directed against the order dated 14.08.2018 passed in R.C. Case No. 10(A)/2010(R) by the learned court of Additional Sessions Judge-VIII-cum-Spl. Judge, CBI, Dhanbad whereby the petition for discharge filed by the petitioner has been rejected in a most mechanical and casual manner and Charge has been directed to be framed against the petitioner, now pending before the learned court of Additional Sessions Judge-VIII-cum-Spl. Judge, CBI, Dhanbad. 3. After some arguments, learned counsel for the petitioner seeks permission to withdraw this petition with liberty to raise all the points taken in this application and the points which may be available under law before the learned court below at appropriate stage. 4. Counsel for the CBI has no serious objection to the prayer made. 5. Accordingly, this petition is dismissed as withdrawn with liberty to the petitioner to raise all the points taken in this application and the points that may be available under law before the learned court below at appropriate stage. 6. It is made clear that withdrawal of this case will not prejudice the case of either parties before the learned court below. 7. Pending I.A, if any, stands dismissed as not pressed. 8.
