JUDGMENT : BISWANATH SOMADDER, J. 1. In re: CAN 8701 of 2018 2. This is an application under section 5 of the Limitation Act. Having heard the learned advocates for the parties and upon perusing the application for condonation of delay, it appears that sufficient cause has been shown by the applicant to explain the delay in filing of the appeal. As such, the delay is condoned. The application for condonation of delay, being CAN 8701 of 2018, is accordingly allowed. In re: MAT 1202 of 2018. 3. By consent of the parties, the appeal is treated as on day's list and taken up for consideration. 4. The instant appeal arises out of an order dated 5th June, 2018, passed by a learned Single Judge in WP 21152 (W) of 2017 (M/s. A and B Developers & Anr. vs. The Kolkata Municipal Corporation & Ors.). By the impugned order, the writ petition stood disposed of. 5. The instant appeal has been preferred by the private respondent no.4, namely, Tapas Dutta. 6. For convenience, the impugned order is reproduced in its entirety here in below:- “The report as called for by the order dated May 4, 2018 filed in Court be taken on record. It appears from such report dated June 4, 2018 that, although the height of the ceiling of the ground floor was lowered by 100mm, the same being within the permissible height, the lowering thereof do not infringe K.M.C. Building Rules 2009. In view of such stand being taken by the corporation authorities, no further order need be passed in the present writ petition. The respondent no.4 is represented. W.P. 21152 (W) of 2017 is disposed of. No order as to costs.” 7. Even a bare perusal of the impugned order reproduced hereinabove does not reveal any palpable infirmity or perversity which would warrant any interference in an Intra-Court Mandamus Appeal. That apart and in any event, the impugned order is supported with cogent and justifiable reasons. 8. The appeal, therefore, is liable to be dismissed and is accordingly dismissed. 9.
