ORDER 1. In the present public interest petition the grievance urged is that 'Gochar' lands are being used for non-agricultural purposes which is contrary to the provision of Rajasthan Tenancy Act, 1955. 2. The State has sought liberty to file an additional affidavit. The additional affidavit filed is taken on record. The relevant extract of the affidavit read as follows :- "3. That in pursuance to the observations of this Hon'ble Court, the Collector Churu vide letter No.863 dated 26.07.2019 has sent the proposal to the Joint Secretary, Revenue Department, Jaipur for reserving land in Tehsil Taranagar, District Churu measuring as follows :- ? 44.04 Bigha Land (Gair Mumkin Tiba) in Khasra No. 1691/103. ? 13.16 Bigha Land (Gair Mumkin Tiba) in Khasra No. 2084/94. ? 10.13 Bigha Land (Barani Doyam) in Khasra No.800/136. 4. That as the total land allotted for the Sainik Basti, Taranagar was 68 bighas, the proposal for a total land measuring 68.13 Bigha in exchange of the Gochar Land has been sent to the Government by the Collector. Copy of the letter dated 26.07.2019 is annexed herewith and marked as Annexure A/1. 5. That the proceedings for setting apart the land as "Gochar" by the State Government in pursuance to the proposal of the Collector is likely to take some time and therefore, the respondents pray for sufficient time for compliance of the Orders of this Hon'ble Court." 3. During the course of hearing, an order of State Government dated 30.07.2019 permitting use of the concerned land for non-agricultural purposes and reserving land to the extent of 68.13 Bigha as alternative land in terms of the proviso to Rule 7(2) of the Rajasthan Land Tenancy Rules has been produced, and the same is hereby taken on record. 4. In view of the above development, nothing survives. No further orders are called for; the writ petition is dismissed.
