By way of the present writ petition, the petitioner has challenged the action of the respondent Mandi in allotting it a smaller size of plot for construction of shop alleging it to be discriminatory and thus, violative of Article 14 of the Constitution of India. 2. Before adverting to the rival contentions, it would be appropriate to lay requisite factual backdrop, which led to allotment of these plots to the petitioner as well as the respondents nos. 5 to 10 at Bhadwasia. 3. A Mandi known as Savitri Bai Fulle Krishi Upaj Mandi (Fal Sabji), Jodhpur (hereinafter referred to as Paota Mandi) is situated at Paota adjacent to Roadways Bus Stand. With the growth of the city, it became necessary that the bus stand at Paota be expanded, hence, the State Government, in pursuance of the directions issued in a PIL, decided to shift the present Mandi at Paota to Bhadwasia and give the land held by Paota Mandi to RSRTC for expansion of the bus stand. Initially, the Mandi at Paota accommodated licensees of all kinds of vegetables and fruits as well, however, in the year 1993, it was decided to shift licensees of onion, potato and fruits to a new Mandi at Bhadwasia. In this process the licensee of such commodities shifted to new Mandi at Bhadwasia in the year 1995, leaving only wholesale traders of vegetables (other than onion potato) and some left out traders of fruits to continue with their business at Paota Mandi. 4. In the year 2013, after long deliberations, a high level meeting of various wings of the State Government was convened under the aegis of Addl. Chief Secretary, Urban Housing and Development Department and after thorough discussions on 7.2.2013, it was decided that the present licensees carrying on business at Paota would be shifted to Bhadwasia and the land of Paota Mandi would be handed over to RSRTC, while the land of RSRTC (depot) existing near the Bhadwasia Mandi would be handed over to Krishi Upaj Mandi for establishment/development of new fruit and vegetable Mandis. 5.

The petitioner's case is that he, having a license to carry on the business/trade of selling fruits as a semi- wholesaler, has been allotted a plot ad-measuring 12' x 30', in the new Mandi at Bhadwasia; whereas the respondents nos. 5 to 10, who too, are semi-wholesalers, have been allotted much bigger plots admeasuring 18' x 50'. Initially, seven petitioners led by M/s. Nanak Ram Narayan Ram felt aggrieved of the decision of the respondents no. 3, as he had allotted bigger shops (ad-measuring 18' x 50') to respondents nos. 3 to 9, mentioned in the list of allottees published by the respondent no. 3 and filed a joint petition, thereafter, petitioners nos. 1 to 3 and 5 to 7 withdrawn their petitions. Now the writ petition is only on behalf of M/s. A Altaf Shah & Brothers (earlier it was M/s. Manakram Narayan Das). 7. The petitioner's contention is that as per the Shifting Policy of 2013, the decisive factor is "license" and not the "kind/nature of business"; hence all the semi-wholesalers should have been allotted equal plots, irrespective of the fact, whether they were dealing in fruits or vegetables. The petitioner has been hostilely discriminated vis-à-vis respondents nos. 5 to 10, who have been allotted shops ad-measuring 18' x 50' feet, simply because they are semi-wholesalers/wholesalers of vegetables. 8. The learned counsel for the petitioner invited attention of this Court towards the averments made in para no. 11 of the writ petition to substantiate his arguments. For the purpose of ready reference the para no. 11 of the writ petition, which encompasses the soul of the controversy is being reproduced hereunder: "11. That recently the petitioner has come to know that the 6 semi wholesalers were included in the list of wholesalers and they are being granted the shops in Bhadwasia Mandi Yard. The similarly situated persons (semi-wholesalers) are being found eligible for allotment of shops as wholesalers at Bhadwasia Yard and respondents have taken decision to allot the shops admeasuring 18 x 50 feet at Bhadwasia Yard. The petitioner though was also entitled to get the shop of 18 x 50 feet at Bhadwasia but he has not considered for the said allotment. To the best of the petitioner's knowledge the names of such persons who are being found eligible for the allotment of 18 x 50 Feet shop are Sunil Brothers, Murlidhar, Bhagwandas, Ramesh Bhai, Madanlal.

To the best of the petitioner's knowledge the names of such persons who are being found eligible for the allotment of 18 x 50 Feet shop are Sunil Brothers, Murlidhar, Bhagwandas, Ramesh Bhai, Madanlal. The name of their firms to the best of petitioner's knowledge are at Sr. No. 56, 146 & 147 in the list of semi-wholesalers. The above referred persons are similarly situated as like petitioner and same is fortified by the list as published by the respondents for semi-wholesalers. Petitioner has visited the office of respondent No. 3 and have asked about the information and the reasons for non-inclusion then it was told by the office that the record and reasons cannot be made available to him as some matter is pending under consideration before this Hon'ble Court." 9. A reply to the writ petition has been filed by the respondents contending inter alia, that respondents nos. 5 to 10 have been allotted plots as per their eligibility & entitlement and that no different treatment has been given to the petitioner. Corresponding reply to para no. 11 of the writ petition reads thus: "11. That the contents of para no. 11 of the writ petition has not been admitted in the manner the same have been averred, however, it is submitted that the six semi wholesalers are allowed to make application for allotment of the shop admeasuring 18 x 50 ft. at Bhadwasia yard on the ground that all these 6 semi wholesalers are doing the business of vegetables and they are depositing the Mandi charges/user charges for the business of vegetables only. That all these six semi wholesalers are doing the business of vegetable and are also paying charges for the same therefore, they are allowed to make application for allotment of the shops for the block of wholesale Sabji market. That the petitioners though are semi wholesalers but they are doing the business of fruits and they are also paying the charges for fruits only. That even the applications submitted by the petitioners for allotment of the shops is for the fruits only and therefore, they are liable to be allotted shops in the block of wholesale fruit market.

Copy of the chart showing the charges deposited by six semi wholesalers as well as one of the application submitted by one of the petitioners is annexed herewith and marked as Annexure R3/2 & R3/3 respectively." 10. During the course of arguments, it has been asserted by the learned Addl. Advocate General appearing on behalf of the respondent-State that in the process of shifting of the present Paota Mandi to Bhadwasia Mandi, the respondents have developed two separate Mandis viz., "Vegetable Mandi" and "Fruit Mandi". As far as Fruit Mandi is concerned, as per the Policy, the wholesalers are to be allotted shops ad-measuring 12' x 30', whereas looking to the nature of the business, the wholesalers of Vegetable are required to be allotted shops ad-measuring 18' x 50'. 11. Learned Addl. Advocate General contended that the petitioner being a wholesaler in Fruit, belongs to a separate class than the respondents nos. 6 to 11 and other businessmen dealing in vegetables. No wholesaler of fruits has been allotted bigger shops (18' x 50). 12. Mr. Manoj Bhandari, learned counsel appearing for the private respondents Nos. 7 to 12 argued that the petitioner has created unnecessary confusion; there is no category called 'semi-wholesaler', there are only two types of licenses, (i) wholesaler and (ii) retailer. He argued that it may be true that the size of shop which the petitioner is having is equal to the size of shops occupied by the respondents, in Paota Mandi, but the basic difference between them is that the petitioner is a wholesale dealer/licensee in Fruits, whereas the private respondents are wholesale - licensees of vegetables. He argued that the respondents have developed two separate Mandis, wherein plots have been earmarked for wholesalers of each trade.

If on account of availability of land, business requirement or for other reasons, if the respondents have created bigger plot size in vegetable Mandi, which have been allotted to his clients, the petitioner should not have grudge, inasmuch as all the licensees of fruits have been allotted smaller plots (12' x 30') while all licensees dealing in vegetables have been allotted bigger plots (18' x 50'). 13. Heard learned counsel and perused the relevant material. 14. It is not the case of the petitioner that any of the respondents and other traders being semi wholesalers in Fruits, have been allotted bigger shop. 15. In considered opinion of this Court, the licensees dealing in fruits and licensees dealing in vegetables form two different classes. If the respondents, after considering the nature of business and other relevant factors have developed two separate Mandis and have taken a Policy decision, which has been uniformly applied to all dealers alike, while keeping in mind their nature of business, it cannot be said that there is a differential treatment much less hostile discrimination meted out to the petitioner, as against the dealers dealing in vegetables. 16. Creation of two classes of dealers, given the fact that two entirely separate Mandis have been developed is a reasonable classification, based on intelligible criterion. Such classification is essential and inevitable, when two separate markets have been developed. 17. As a matter of fact, presently licensees of vegetables and fruits are/have been operating in the Paota Mandi. Later on, the respondents have decided to establish two separate Mandis at Bhadwasia; (i) Bhadwasia Fruit Mandi and (ii) Bhadwasia Vegetable Mandi. The decision of the State Government taken in its meeting dated 7.2.2013 (reproduced hereinabove, particularly paras nos. 2 and 4 thereof) leaves no room for ambiguity that it was decided by all concerned that the traders engaged in a particular nature of business viz., vegetables and fruits will be allotted plots/shops as per their business. 18. The petitioner's argument has been that as per Transfer Policy, 2013, particularly clauses (7) and (8), the basis of allotment of shop was the existing shop in Paota Mandi and the same cannot be changed to nature of business.

In considered opinion of this Court, clauses (7) and (8) of the Transfer Policy of 2013 deals with the right of licensees carrying on their business in existing Mandi at Paota. According to the Policy of 2013, the petitioner as well as the respondents nos. 7 to 12 have a right of allotment of plot/shop at new Mandi at Bhadwasia; however, as far as size of the plot is concerned, the Policy of 2013 neither throws any light nor does it have any provision governing size of the plot. 20. Hence, if the respondents have decided to develop two separate Mandis and have chosen to allot shops based upon their nature of business for the ease and convenience of the business, no fault can be found in such decision. 21. Clauses (7) and (8) of the Policy, if interpreted purposively, in the backdrop of above facts, their stand turns out to be perfectly just and proper. If they have developed plots ad-measuring 12' x 30' for wholesalers of fruits, as against plots of 18' x 50' for wholesalers of vegetables and allotted the same consider their business, then, regardless of the fact that their existing shops at Paota are equal in size, they can be allotted different size of plots in new Mandi at Bhadwasia, particularly when, two separate Mandis have been developed for vegetable and fruits. 22. This being the position, this Court finds no substance in the petitioner's petition, hence, the same is dismissed. 23. The stay application also stands disposed of accordingly.
