JUDGMENT : Abhinava Upadhya, J. 1. Heard Sri Ashok Khare, learned senior Advocate assisted by Sri Shantanu Khare learned counsel for the petitioner, Sri Vaibhav Kaushik appears for respondent No. 3 and learned standing counsel represents respondent Nos. 1 and 2. 2. The petitioner had appeared in selection of Assistant Professor (Hindi) pursuant to the advertisement No. 47. The selection process comprises of written test as well as oral interview. The petitioner was given O.M.R. sheet in the written test with series No. 'A' which was subsequently taken away by the Invigilator and the petitioner was given series No. 'C' with the counter, sign of the Invigilator as has been alleged by the petitioner in the writ petition. 3. It is submitted that the written examination was held on 5.1.2019 and the petitioner immediately after examination on 7.1.2019 represented before the authorities giving the facts mentioned herein above but the result of the petitioner has not been declared and later on the name of the petitioner has been included in the list of rejected candidates published on 4.7.2019. It is furrier submitted by the petitioner that he again represented before the concerned authorities but no action has been taken so far. 4. In my view no fruitful purpose will be served in keeping the matter pending as this writ petition is being disposed of with a direction to respondent No. 3/U.P. Higher Education Services Commission Prayagraj to consider the claim of the petitioner with regard to change of question series from A to 'C' by the Invigilator and pass an appropriate order as far as possible within a period of one month for the date of presentation of certified copy of this order before it.
