JUDGMENT Shekher Dhawan, J. - Present petition under Section 438 Cr.P.C. for seeking pre-arrest bail to the petitioner, namely Jasvir Singh in case FIR No. 130 dated 25.12.2018, registered under Section(s) 22(C) of the Narcotic Drugs & Psychotropic Substances Act, 1985 (hereinafter referred to as "the Act") at Police Station Rori, District Sirsa, Haryana. 2. As per prosecution case, petitioner as well as his co-accused, namely Satpal Singh were found to be in possession of 1440 tablets of Alprazolam, while they were travelling on a motorcycle. Learned counsel for the petitioner contended that conscious possession of alleged recovery was not effected from the present petitioner, but from the other person who was pillion rider of the motor cycle. Learned counsel further contended that petitioner is not involved in any other case under the Act and he is ready to join the investigation. 3. Notice of motion. On asking of the Court, Mr. Ashish Sanghi, Deputy Advocate General, Haryana accepts notice on behalf of respondent. A copy of paper-book be provided to him during the course of the day. 4. Having considered the submissions made by learned counsel for the petitioner, the alleged recovery effected form the petitioner as well as his co-accused is of commercial quantity and it shall be the matter of intensive investigation only, for which purpose, custodial interrogation of petitioner would be required. As such, no case is made out to grant the concession of pre-arrest bail to the petitioner and present petition stands dismissed.
