JUDGMENT : Shekher Dhawan, J. Present petition under Section 438 of the Code of Criminal Procedure is for grant of anticipatory bail to the petitioner in case bearing FIR No. 01 dated 12.04.2019 under Sections 406 and 34 IPC (Sections 392, 411, 412 and 120-B IPC added later on) and Sections 13(1)(a) and 13 (2) of the Prevention of Corruption Act, 1988 (for short, "the Act") registered at Police Station Punjab State Crime, SAS Nagar, District SAS Nagar, Mohali. 2. Allegations against the present petitioner are that ASI Joginder Singh had given 20 bundles of Rs.2000/- (totaling Rs.40.00 Lacs) and he had kept concealed the same in the double bed lying in his bed room and on the basis of said disclosure statement, he got recovered said looted money from the disclosed place. 3. Learned counsel for the petitioner contended that the petitioner has been falsely implicated in this case. The police had raided the house of the accused and the petitioner was joined for the purpose of investigation. Recovery has also been effected. So, custodial investigation of the present petitioner is not required. The petitioner is a heart patient and he be released on pre-arrest bail. 4. Notice of motion. 5. Mr. Ramandeep Sandhu, Senior DAG, Punjab accepts notice. 6. Learned State counsel opposed the bail application on the ground that the petitioner is one of the accused in a racket and he had kept concealed the currency notes which were ultimately recovered from him. 7. Having considered the submissions made by learned counsel for the parties and appraisal of record of this case file, this Court is of the considered view that there are serious allegations against the petitioner. No case is made out for release of the petitioner on pre-arrest bail. The present petition stands dismissed.
