JUDGMENT : Gurvinder Singh Gill, J. The complainant Manpreet Kaur has approached this Court seeking issuance of directions to respondent No. 2 to get fair and impartial investigation conducted with respect to role of respondents No. 4 to 7 in FIR No.47 dated 17.8.2017 under Sections 406 and 498-A IPC registered at Police Station Women Cell, District Amritsar. 2. The petitioner alleged that the aforesaid FIR was registered against her husband Paramveer Singh, father-in-law Varinder Singh, mother-in-law Arwinder Kaur and brother-in-law Ishvinder Singh. It has been alleged that the petitioner was married to respondent No. 4 Paramveer Singh on 14.2.2015 wherein huge dowry in the shape of gold jewellery and other articles were given. A baby girl was born out of the wedlock. It is alleged that the respondents No. 4 to 7 were, however, not happy with the dowry and had been taunting and harassing the petitioner in order to press upon their demand for more dowry in the shape of a car and cash amount of Rs. 10 lacs. It is further alleged that respondent No. 4 even scolded the petitioner for having given birth to a female child. The petitioner further alleged that the situation became bad to worse and ultimately the accused threw out the petitioner and her minor child out of her matrimonial home in the last week of June, 2016. 3. The learned counsel for the petitioner has submitted that although the complainant had furnished complete evidence to the police pertaining to Istri dhan including jewellery and other articles and had even produced the same before the Family Welfare Committee to whom the case has been referred to but the said Family Welfare Committee had given a biased report giving clean chit to the accused father-in-law and mother-in-law of the petitioner-complainant. It has, thus, been prayed that direction be issued for getting the matter investigated in a proper manner and to take appropriate action against all the accused. 4. Opposing the petition, the learned State counsel has submitted that the matter has been investigated and enquired into in accordance with law in an unbiased manner. It has further been submitted that the entire evidence which is found reliable and convincing shall be considered by the prosecution. 5. It is a case of matrimonial discord wherein the allegations are mainly to the effect that the accused had been demanding dowry and that the articles of Istri dhan allegedly given by the complainant and her family to the accused had been misappropriated. 6. Reply by way of affidavit of Dr. Richa Agnihotri, Assistant Commissioner of Police, Amritsar City had been filed, which is accompanied by a recovery memo in respect of recovery of some articles from the accused Paramveer Singh, the details of which are as follows :- "1. One Kundan set of pearls in which one necklace garland + one pair of ear rings weight 118-420 gms. 2. One gold necklace with one pair of ear rings, on which radium has been polished, weight 29-670 gms. 3. One pendal gold set with one pair of ear ring weight 17-550 gms. 4. One gents gold 'karah' on which radium has also been polished, weight 21-100 gms. 5. one lady ring gold + diamond weight 3.630 gms. 6. one gents gold right, weight 4.850 gms. 7. one gents gold ring weight 4.990 gms. 8. one gents gold ring, diamond are engraved therein, weight 9.530 gms. 9. two shawls. 10. one lady's unstiched suit 11. one piece of unstitched kot pant." 7. In the present case, the case had been referred to the Family Welfare Committee wherein the father-in-law and mother-in-law of the complainant had been found to be innocent. 8. Having heard the learned counsel for the parties, this Court does not find any case for issuance of any direction at this stage. The petition, as such, is disposed of while directing the investigating agency/prosecution as well as the trial Court not to be absolutely bound by the report of the Family Welfare Committee and to proceed ahead with the case independently on the basis of such evidence as may be produced by the prosecution. 9. The petition is disposed of accordingly.
