JUDGMENT : Gurvinder Singh Gill, J. The petitioner Paramveer Singh has approached this Court seeking grant of anticipatory bail in a case registered against him vide FIR No.47 dated 17.8.2017 under Sections 406 and 498-A IPC at Police Station Women Cell, District Amritsar. 2. The FIR was registered at the instance of Manpreet Kaur against Paramveer Singh (husband), Varinder Singh (father-in-law), Arwinder Kaur (mother-in-law) and Ishvinder Singh (brother-in-law) wherein it has been alleged that the complainant Manpreet Kaur was married to the petitioner Paramveer Singh on 14.2.2015 wherein huge dowry in the shape of gold jewellery and other articles were given to the accused. A baby girl was born out of the wedlock. It is alleged that the accused were, however, not happy with the dowry and had been taunting and harassing the complainant in order to press upon their demand for more dowry in the shape of a car and cash amount of Rs. 10 lacs. It is further alleged that the accused even scolded the complainant for having given birth to a female child. The complainant alleged that the situation became bad to worse and ultimately the accused threw out the complainant and her minor child out of her matrimonial home in the last week of June, 2016. 3. The learned counsel for the petitioner has submitted that he has falsely been implicated in the present case and infact it is a case of matrimonial incompatability between the parties and that the complainant has lodged FIR by levelling false allegations in order to pressurize the petitioner so as to extort money from him. 4. Opposing the petition, the learned State counsel assistated by learned counsel for the complainant has submitted that the accused and other members of his family had misappropriated all the articles of 'istridhan' and some gold jewellery was yet to be recovered and in these circumstances, the petitioner does not deserve the concession of bail. The learned State counsel has, however, informed that as per recovery memo dated 24.2.2018, the recovery of the following articles has been effected from the accused, the details of which are as follows :- "1. One Kundan set of pearls in which one necklace garland + one pair of ear rings weight 118-420 gms. 2. One gold necklace with one pair of ear rings, on which radium has been polished, weight 29-670 gms. 3.

One gold necklace with one pair of ear rings, on which radium has been polished, weight 29-670 gms. 3. One pendal gold set with one pair of ear ring weight 17-550 gms. 4. One gents gold 'karah' on which radium has also been polished, weight 21-100 gms. 5. one lady ring gold + diamond weight 3.630 gms. 6. one gents gold right, weight 4.850 gms. 7. one gents gold ring weight 4.990 gms. 8. one gents gold ring, diamond are engraved therein, weight 9.530 gms. 9. two shawls. 10. one lady's unstiched suit 11. one piece of unstitched kot pant." 5. I have considered rival submissions addressed before this Court. Apparently, the case has arisen out of matrimonial discord between the parties. The veracity of the allegations is yet to be established and as such, it may not be appropriate to make any observations on merits of the case. The petitioner, in any case, has already joined investigation. In my opinion, the facts and circumstances of the case do not warrant any custodial interrogation. 6. The petition, as such, is accepted and the interim directions issued vide order dated 9.2.2018 are hereby made absolute subject to the condition that the petitioner shall appear and join the investigation as and when called upon to do so and cooperate with the Investigating Officer and shall abide by the conditions as provided under Section 438(2) Cr.P.C. 7. The petition stands accepted accordingly.
