JUDGMENT : BISWANATH SOMADDER, J. 1. By consent of the parties, the appeal is treated as on day's list and taken up for consideration along with the application for stay. 2. The instant appeal arises out of an order dated 7th February, 2019, passed by a learned Single Judge in WP 1783 (W) of 2019 (Srikanta Mondal vs. The State of West Bengal & Ors). 3. By the said order, the learned Single Judge was pleased to dispose of the writ petition with certain directions. 4. The instant appeal has been preferred by the private respondents in the writ proceedings, namely, Biplab Mondal and five others. 5. For convenience, the operative portion of the impugned order passed by the learned Single Judge is set out herein below:- "The petitioner is entitled to police picket, upon payment of requisite cost. Learned advocate appearing for the State submits on written instructions that some more time is required to assess the cost to inform the petitioner about the same. In such circumstances, the police authorities will assess the cost payable by the petitioner within a period of seven days from date. Immediately on deposit of such cost, the police will extend the assistance as sought for by the petitioner. W.P.No.1783 (W) of 2019 is disposed of." 6. The apprehension of the appellants appears to be that if a police picket is provided at the instance of the respondent no.1/writ petitioner, it will tantamount to their ouster from the place occupied by them and will also allow illegal construction by the respondent no.1/writ petitioner. 7. We, however, do not notice any observation made in the impugned order, which confirms such apprehension of the appellants. As such, we need not go into the issue as sought to be brought forth by the appellants in the instant appeal. If there is any question with regard to the appellants being sought to be ousted from their possession/occupation or any issue with regard to illegal construction being carried out by the respondent no.1/writ petitioner, it is well within the rights of the appellants to take necessary steps in accordance with law. However, so far as the order impugned before us is concerned, the same does not warrant any interference in an Intra-Court Mandamus Appeal. 8. The appeal and the application for stay stand dismissed with the above observations. I agree. - (Md. Nizamuddin, J.)
