JUDGMENT : This Court passed the following order on 23.09.2019: Pursuant to the orders passed by this Court on 10.09.2019 and 18.09.2019, the second respondent produced the detenue before this Court. 2. We enquired the detenue, viz., Naga Nandhini, who stated that her date of birth is 07.10.2001 and that she would be attaining majority next month. She specifically stated that she fell in love with the third respondent and she went along with him on her own and she was living in Chennai for the last two months. 3. The parents of the detenue were also present before this Court. They stated that they will get their daughter married to the third respondent and that they will not go against the interest of their daughter. 4. The learned Additional Public Prosecutor, on instructions, submitted that the third respondent was remanded to judicial custody yesterday (22.09.2019). That apart, the father of the third respondent and the brother of the third respondent, who are arrayed as fourth and fifth respondents continue to be in judicial custody. 5. Taking into consideration the facts and circumstances of the case, we appointed Mr.K.Sathishkumar (Enrollment No.3082/2011, No.102 Law Chamber), as an Amicus Curiae/Legal Aid counsel to represent respondents 3 to 5. We direct the second respondent to furnish all the relevant papers to the learned counsel, in order to enable him to file an interim bail petition before this Court, on behalf of the respondents 3 to 5. 6. Post this case on 24.09.2019. The detenue will stay along with her parents until further orders are passed in this petition. The presence of the detenue and her parents is dispensed with and they shall appear as and when required by this Court. 2. Pursuant to the above order, the present Petition seeking for interim bail has been filed by respondents 3 to 5. 3. Taking into consideration the facts and circumstances of the case and also the fact that the continued incarceration of these Petitioners will not be in the interest of both the detenu as well as the third respondent and also the fact that the second and third Petitioners are only the father and brother of the first Petitioner, we are inclined to grant interim bail to the Petitioners in exercise of our jurisdiction under Article 226 of the Constitution of India, to meet the ends of justice. 4.

The interim bail is granted to the Petitioners subject to the following conditions: (a) the Petitioners shall execute a bond for Rs.5,000/-(Rupees five thousand only) with one surety each for like-sum, to the satisfaction of the Mahila Court, Dindigul. (b) the first Petitioner shall appear before the third respondent/Police daily at 10.30 a.m until further orders. (c) the second and third Petitioners shall appear before the third respondent/Police as and when required. 5. Post this Petition along with the main Habeas Corpus Petition on 1.10.2019. The Petitioners shall be present before this Court on that day. The Legal Services Committee, Madurai Bench of Madras High Court, Madurai is directed to pay a sum of Rs. 5,000/- to the learned counsel who was appointed by this Court to file this interim bail Petition and for the services rendered by him by assisting this Court.
