JUDGMENT : T.S. Sivagnanam, J. (Prayer: Petition filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, forbearing these respondents to construct the Taluk Office building and Tahsildar quarters in 2 (Hec) in S.No.1/3 in Karadu Puramboke in Idaikal Village in Kadayanallur Taluk in Tirunelveli District, within a time frame and stipulated time period fixed by this Hon'ble High Court.) Heard Mr. F.X. Eugene, learned counsel appearing for the petitioner, Mr. A.K. Baskarapandian, learned Special Government Pleader appearing for the respondents 1 to 7 and Mr. M. Mahaboob Athiff, learned counsel appearing for the 8th respondent. 2. By way of this Writ Petition, the petitioner seeks for issuance of a Writ of Mandamus, directing the respondents to construct the Taluk Office building and Tahsildar quarters in 2 (Hec) in S.No.1/3 in Karadu Puramboke in Idaikal Village in Kadayanallur Taluk in Tirunelveli District, within a time frame. 3. According to the petitioner, the place already chosen and earmarked for locating Taluk Office for Kadayanallur Taluk should not be changed and it will serve the interest of the public. 4. The official respondents have taken a decision. In our considered view, it is better to leave the matter to be decided by the administrative authorities viz., the District Collector and other officials. We make it clear that absolutely there should be no political interference in the matter of selection of the location. Though, the newly impleaded 8th respondent is a Member of the Legislative Assembly, he should ensure that the interest of public is sufficiently safeguarded and there should be no private interest. Therefore, we direct the District Collector, Tirunelveli District and other officials to take an informed decision in the matter as to where the Taluk Office is to be located and what are the facilities required to be provided and such decisions shall be taken in the best interest of the local public. 5. The Writ Petition stands disposed of with the above directions and observations. Consequently, connected Miscellaneous Petition is closed. No costs.
