JUDGMENT : Shekher Dhawan, J. Present petition under Section 439 of the Code of Criminal Procedure is for grant of regular bail in case bearing FIR No. 76 dated 11.04.2019 under Section 7 of the Prevention of Corruption Act,1988 (for short, "the Act") and Sections 409 and 120-B IPC registered at Police Station Ajnala, District Amritsar Rural. 2. Learned senior counsel for the petitioner contended that the petitioner is in custody in this case since 13.04.2019. The main allegations are against co-accused Manjinder Singh only, whereas the petitioner was working as driver with the main accused. Investigation is already complete. Trial of this case still to take some more time, no purpose would be served by keeping the petitioner behind the bars. So, the petitioner be released on bail. 3. Learned State counsel as also learned counsel representing the complainant contended that the allegations against the petitioner are serious in nature and he is not entitled to be released on bail. 4. Having considered the submissions made by learned counsel for the parties and the fact that the petitioner is in custody since 13.04.2019 investigation is already complete; mainly the allegations are against Manjinder Singh and the allegation against the petitioner is that he used to collect bribe money from the public for and on his behalf, this Court is of the considered view that no purpose would be served by keeping the petitioner behind the bars as trial of this case still to take some more time. 5. Resultantly, without expressing anything on merits and keeping view the fact that the investigation is complete and the petitioner is in custody since 13.4.2019, the present petition stands allowed and petitioner, Harjeet Singh alias Happy is ordered to be released on regular bail subject to his furnishing bail bonds/surety bonds to the satisfaction of the trial Court/Chief Judicial Magistrate/Duty Magistrate concerned. 6. Any observation made herein above shall have no bearing on the merits of the case.
