JUDGMENT : S. Vaidyanathan, J. Prayer: To direct the Respondents to consider the Petitioners Representation dated 24.09.2019. The Writ Petition has been filed, seeking for a direction to the Respondents to consider the petitioner's representation dated 24.09.2019, by which, he had requested the Government to pay a compensation of Rs.1,00,00,000/- for the death of his daughter, which happened on account of fall of an illegally erected banner. 2. This Court cannot at this stage decide as to whether any amount is payable to the petitioner as compensation or not, as admittedly a batch of Writ Petition is pending before the some other Division Bench in W.P.Nos.16307 etc. batch, in which the erection of banners, including digital banner is the subject matter of that batch. It is very sad that the petitioner lost his daughter in a tragedy and therefore the persons responsible for erecting the banner has to be dealt in accordance with law. At the same time, we do not want to express any opinion on merits at present in view of pendency of a batch of Writ Petitions before the co-ordinate Bench which is seized of the issues. 3. The petitioner has, apart from seeking compensation, sought for formation of a Special Investigating Committee to look into such illegal banners. Since this Court is already seized of the matter in respect of the very same issue, any order passed in this Writ Petition will definitely have a bearing on the pending Writ Petitions and therefore, we are of the firm view that this Writ Petition has go to be tagged with the pending Writ Petitions, so that the petitioner will get a fair opportunity of being heard to forth his submissions. 4. Though we have not lost sight of the fact that the First Bench of this Court had, in its order dated 20.12.2017 in W.A.No.1340 of 2017, permitted the inclusion of “Live Person” in the Banner, holding that the Statute or Rules do not prohibit such inclusion, the Hon'ble Division Bench, while considering the batch of writ petitions, may also consider as to whether till the amendment made in the statute or Rules, such inclusion of “Live Person” in the banner may be prohibited or not. 5. 5. Secondly, Division Bench may also consider whether the authority sanctioning permission can call for furnishing of Aadhar card details from the printer concerned and the person requesting for erection of banners so that the details of such persons including their photo identity are available in the records for taking action if required for any breach of rules and guidelines. 6. Since the issue requires a detailed adjudication, Registry is directed to list this matter before the Hon'ble Division Bench, consisting of Mr.Justice M.Sathyanarayana and Mr.Justice N.Seshasayee, along with the pending Writ Petitions in W.P.Nos.16307, etc batch for hearing. At this juncture, it is represented by the Respondents that the batch of Writ Petition is posted for hearing on 23.10.2019. In view of the above submissions, list this matter on 23.10.2019. along with other batch of Writ Petitions aforestated.
