JUDGMENT : Shashi Kant Gupta and Piyush Agrawal, JJ. 1. This writ petition has been filed, inter alia, for the following relief: "to issue a writ, order or direction in the nature of certiorari calling for the record and quashing the impugned recovery proceedings and quashing the recovery citation, if any, issued against the petitioner." 2. Learned counsel for the petitioner submits that challenging the order dated 2.5.2019 passed by the respondent No. 3, whereby the lease granted in favour of the petitioner has been terminated, the petitioner has filed an appeal alongwith a stay application under Rule 77 of the U.P. Minor Mineral (Concession) Rules, 1963 before the respondent No. 2 on 23.5.2019 and the said appeal is still pending and no order has been passed on the stay application. 3. Heard the learned counsel for the parties and perused the record. 4. Considering the facts and circumstances of the case, without expressing any opinion on the merits of the case, this writ petition is finally disposed of with a direction to the respondent No. 2, Commissioner, Jhansi Division, Jhansi to decide the aforesaid appeal of the petitioner as well as the stay application expeditiously, preferably, within a period of one month from the date of receipt of a certified copy of this order. 5. It is made clear that this court has not expressed any opinion on the merits of the case and the appellate authority has to take decision on its own merits.
