JUDGMENT Pushpendra Singh Bhati, J. - These two appeals are arising out of the same accident and common judgment & award dated 8.10.1999. 2. The unfortunate accident happened on 23.10.1993 when Udai Singh, Chain Singh and others were going in Maruti Omni Taxi No. HRU 4573-A from Delhi to their village. The vehicle was being rashly driven and turned turtle as a result whereof, Udai Singh and Chain Singh died at the spot and others were injured. 3. Learned counsel for the appellants/claimants submits that the compensation awarded by the learned Tribunal is too meagre. No calculation has been made by the learned Tribunal and only a meagre amount of Rs.30,000/- (S.B. Civil Misc. Appeal No.874/1999) and Rs.60,000/- (S.B. Civil Misc. Appeal No.873/1999) has been awarded. Learned counsel for the appellants submit that no standard criteria for determining the compensation has been adopted and thus, the compensation awarded needs to be enhanced. 4. On the direction of this Court, learned counsel Mr.Jagdish Vyas was directed to take instructions to appear on behalf of the respondent insurance company, which he has taken. Learned counsel for the respondent submits that the dependency has not been proved and even wife had remarried immediately and there are no children. Moreover, dependency of father has not been made. 5. After hearing the learned counsel for the parties and after perusing the record, this Court is of the opinion that the ends of justice would met by enhancing the compensation while adhering to parameters laid down by the Hon'ble Supreme Court in the case of Sarla Verma and ors. vs. DTC and Ors.,2009 6 SCC 176 . Thus, this Court deems it proper that the awarded amount be enhanced by Rs.60,000/- in S.B. Civil Misc. Appeal No.874/1999 and by Rs.60,000/- in S.B. Civil Misc. Appeal No.873/1999 respectively. 6. Both the appeals are accordingly disposed of. The respondent insurance company is directed to pay the enhanced amount of Rs.60,000/- in S.B. Civil Misc. Appeal No.874/1999 and Rs.60,000/- in S.B. Civil Misc. Appeal No.873/1999 respectively alongwith interest @ 6% per annum from the date of filing of claim petition till actual payment is made. The enhanced amount is to be paid within three months from today, failing which the same shall carry interest @ 9% per annum for the subsequent period (i.e. after three months from today) till actual payment is made. 7.
