JUDGMENT Mr. Ajay Tewari, J. (Oral) - This petition has been filed under Section 439 Cr.P.C. for grant of regular bail to the petitioner in case F.I.R. No.129 dated 29.11.2018 registered under Sections 420/120-B IPC at Police Station Verowal, District Tarn Taran. 2. As per the allegations in the FIR the petitioner had obtained loan of Rs.28.00 lakhs over the period 2013 to 2016 from the complainant by way of cheques and in order to return the amount had given five cheques (as it ultimately transpired) from an account which stood closed. Admittedly the petitioner has been in custody for 1 ½ months. 3. Learned counsel for the petitioner states that actually on the last date matter had been adjourned to enable the State Counsel to see the transaction by which the money had been transferred to the account of the petitioner. 4. Today Deputy Advocate General on instructions from ASI Baljinder Singh states that there are only two transactions to the bank on the record totaling Rs.2.00 lakhs. 5. Keeping in view the above facts and the period of incarceration already suffered by the petitioner, without going into the merits of the case, I deem it appropriate to release the petitioner on regular bail to the satisfaction of the trial Court/Duty Magistrate. Ordered accordingly. Petition stands allowed. 6. Since the main case has been decided, the pending criminal miscellaneous application, if any, also stands disposed of.
