JUDGMENT Anupinder Singh Grewal, J. (Oral) - The petitioner is seeking anticipatory bail in FIR No. 280 dated 27.08.2019, under Sections 420, 468 and 120-B of the Indian Penal Code, 1860, registered at Police Station Division No. 5, Ludhiana, District Ludhiana. 2. Learned counsel for the petitioner contends that the allegations against the petitioner are that he had received cheques for a sum of Rs. 1,86,800/-and Rs. 75,024/- in the name of the firm which was in partnership with the complainant, but the same were deposited by him in his own firm. He, however, contends that the cheques were deposited in the firm, namely, Cool Wave Air Condition and Refrigeration, which was a partnership firm with the complainant. He also contends that the allegations point to a civil dispute between the partners. This Court, by order dated 16.10.2019, had directed the petitioner to appear before the Investigating/Arresting Officer and join the investigation and in the event of his arrest, he was to be released on ad-interim bail to the satisfaction of the Investigating/Arresting Officer, subject to the conditions envisaged under Section 438(2) Cr.P.C. 3. Learned State counsel, upon instructions from ASI Manjeet Singh, states that the petitioner has joined investigation and is not required for custodial interrogation. 4. In view of the submissions of learned counsel for the petitioner and the petitioner having joined investigation and not required for custodial interrogation, the order dated 16.10.2019 granting interim bail to the petitioner is made absolute. 5. However, the petitioner shall abide by the conditions stipulated under Section 438(2) Cr.P.C. He shall also join investigation as and when called upon to do so. 6. The petition stands disposed of.
