JUDGMENT Sangeet Lodha, J. - Heard learned counsel for the applicant and learned public prosecutor. Perused the material on record. 2. The applicant has been arrested in connection with FIR No.409/19 of Police Station Mandore, District Jodhpur for the offence punishable under Section 8/18 of the NDPS Act. 3. Learned counsel appearing for the applicant submits that the quantity of the contraband opium milk recovered from the applicant and co-accused, is only 870 grams which is below commercial quantity. It is submitted that co-accused Anil and Suresh Bishnoi have already been enlarged on bail by Coordinate Bench of this Court vide orders dated 28.11.19 & 20.11.19 passed in S.B.Cr. Misc. Bail Application No.14445/19 and 14122/19 respectively, and the case against the applicant is not distinguishable from the case as against the co-accused who are already enlarged on bail. 4. Learned public prosecutor has opposed the bail application, however, it is not disputed that the case against the applicant qua other co-accused who have already been enlarged on bail, is not distinguishable. 5. Having regard to the nature of accusation and taking into consideration totality of the facts and circumstances of the case, without expressing any opinion on the merits of the case, I deem it just and proper to enlarge the accused applicant on bail. 6. Accordingly, this bail application filed under Sec.439 Cr.P.C. is allowed and it is directed that applicant Ashok s/o Kanwara Ram, shall be released on bail in connection with FIR No. 409/2019 of Police Station, Mandore, District Jodhpur, provided he executes a personal bond for a sum of Rs. 50,000/- with two sound and solvent sureties of Rs. 25,000/- each to the satisfaction of learned trial court for his appearance before that court on each and every date of hearing and whenever called upon to do so till the completion of the trial.
