JUDGMENT Sangeet Lodha, J. - Heard learned counsel for the applicant and learned Public Prosecutor and also perused the material available on record. 2. The applicant has been arrested in connection with F.I.R. No.81/2018-19 registered at Police Station-Excise Prevention Team, Khairwara, District Udaipur, for offences punishable under Section 19/54 and 54-A of the Rajasthan Excise Act. 3. Learned counsel appearing for the applicant submits that the offences alleged to have been committed by the applicant are triable by the Magistrate. It is submitted that the applicant is behind the bars since 03.11.2019. 4. Learned Public Prosecutor vehemently opposed this bail application. 5. Having regard to the facts and circumstances of the case and without expressing any opinion on the merits of the case, this 6. Court is of the opinion that the bail application filed by the applicant deserves to be accepted. 7. Consequently, the bail application filed under Section 439 Cr.P.C. is allowed. It is ordered that applicant Nilesh Kumar S/o Mahendra Singh Gohila, arrested in FIR No.81/2018-19 registered at Police Station-Excise Prevention Team, Khairwara, District Udaipur shall be released on bail; provided he executes personal bond in the sum of Rs.50,000/- and two sureties of Rs.25,000/- each to the satisfaction of the learned trial Court with the stipulation to appear before that Court on all dates of hearing and as and when called upon to do so.
