JUDGMENT : Pankaj Bhandari, J. 1. Petitioner has filed this bail application under Section 439 of Cr.P.C. 2. F.I.R. No. 473/2019 was registered at Police Station Malviya Nagar, Jaipur for offence under Sections 420, 406, 384, 120-B of I.P.C. 3. It is contended by counsel for the petitioner that petitioner is the proprietor of the Firm Sky Silver International. Complainant was having business transaction with her. She was purchasing jewellery from petitioner. Cheque given by her was dishonored, on which a notice was delivered to her under Section 138 Negotiable Instrument Act. It is contended that out of the criminal antecedents, police has submitted negative final report in two cases and in one case parties have entered into compromise. 4. Learned Public Prosecutor and counsel for the complainant have opposed the bail application. It is contended that complainant was deceived and amount was taken from her on the pretext that she would be sent to foreign country and business would be established in foreign country. It is also contended that the matter is still at the stage of investigation. 5. I have considered the contentions. 6. Considering the contentions put forth by counsel for the petitioner and also taking note of the fact that petitioner is a female and from the documents submitted, it is established that jewellery was sold by petitioner to complainant hence without commenting on the merits of the case, I deem it proper to allow the bail application. 7. This bail application is accordingly allowed and it is directed that accused petitioner shall be released on bail provided he furnishes a personal bond in the sum of Rs. 1,00,000/- (Rupees One Lac only) together with two sureties in the sum of Rs. 50,000/- (Rupees Fifty Thousand only) each to the satisfaction of the learned trial court with the stipulation that he shall appear before that Court and any court to which the matter is transferred, on all subsequent dates of hearing and as and when called upon to do so.
