JUDGMENT Vijay Bishnoi, J. - Heard learned counsel for the petitioners as well as learned Public Prosecutor and also perused the material on record. 2. The petitioners have been arrested in FIR No.305/2019 of Police Station Sangriya District Hanumangarh for the offences punishable under Sections 307, 323, 325, 341, 427, 147, 149 IPC. They have preferred these bail applications under Section 439 Cr.P.C. 3. Learned counsel for the petitioners has submitted that the allegation of inflicting injury on the head of the injured Rajendra is against Ramlal Bawari, however, police have not filed charge-sheet against him and concluded that they have falsely been implicated in this case. It is further submitted that omnibus allegations have been levelled against the petitioners and no specific role has been assigned to them. It is also argued that the co-accused persons have already been enlarged on bail and case of the petitioners is not distinguishable from them. 4. Learned Public Prosecutor has opposed the bail application. 5. Having regard to the totality of the facts and circumstances of the case and after going through the charge-sheet and taking into consideration the fact that similarly situated co-accused persons have already been enlarged on bail, without expressing any opinion on the merits of the case, I deem it just and proper to grant bail to the accused petitioners under Section 439 Cr.P.C. 6. Accordingly, these bail applications filed under Section 439 Cr.P.C. are allowed and it is directed that petitioners Gugan Ram S/o Shri Rampratap and Pala Ram @ Jaipal S/o Shri Rati Ram shall be released on bail in connection with FIR No.305/2019 of Police Station Sangriya District Hanumangarh provided each of them executes a personal bond in a sum of Rs.50,000/- with two sound and solvent sureties of Rs.25,000/- each to the satisfaction of learned trial court for his appearance before that court on each and every date of hearing and whenever called upon to do so till the completion of the trial.
