JUDGMENT Alka Sarin, J. - The present revision has been filed against the order dated 18.01.2017 (Annexure P/4) passed by the Civil Judge (Senior Division), SAS Nagar, Mohali whereby the application for restoration of the suit filed by the petitioner/plaintiff has been dismissed. The suit was dismissed in default on 06.07.2015. 2. Learned counsel for the petitioner has stated that non-appearance of counsel for the plaintiff on 06.07.2015 was unintentional, as the matter, which was pending in the court of Civil Judge (Junior Division), Mohali, was assigned to another Court owing to transfer of the Presiding Officer and the counsel was not aware of the same. The trial Court has dismissed the application for restoration of the suit on the ground that plaintiff had not put in appearance on 08.05.2015 and thereafter on 06.07.2015, when the suit was dismissed in default. It has been observed by the trial Court that since the applicant was very casual about the proceedings, hence, he d i d not deserve the relief prayed for. 3. Nobody has put in appearance for the respondents/defendants today though they stand duly served. I have heard learned counsel for the petitioner and am convinced that the non-appearance on 06.07.2015 was neither intentional nor wilful. The application for restoration of the suit was filed at the earliest on 27.07.2015 after the suit was dismissed in default on 06.07.2015. There was no delay on the part of the petitioner/plaintiff. The suit was for recovery on which the petitioner/plaintiff had affixed ad-valorem court fee. The suit was at the stage of cross-examination when it was dismissed in default. The trial court has not taken these factors into consideration while passing the impugned order which factors show that the petitioner/plaintiff was serious qua the legal proceedings initiated by him. The petitioner/plaintiff thus ought to be permitted to pursue with his suit. I, therefore, deem it appropriate to restore the suit to its original number. 4. Revision petition accordingly stands a I lowed subject to payment of costs of Rs.5,000/- which shall be deposited by the petitioner/plaintiff with the District Legal Services Authority, Mohali. The impugned order dated 18.01.2017 (Annexure P/4) is set aside and the suit of the petitioner/plaintiff is restored. Parties to appear before the trial court on 16.12.2019.
