JUDGMENT Shree Chandrashekhar, J. - The petitioners have challenged the order taking cognizance dated 07.07.2011 by which cognizance of the offence under sections 406/419/420/34 I.P.C read with section of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989 has been taken. The petitioners have also challenged the order by which processes under section 82/83 Cr.P.C have been issued against them. 2. After arguing for some time, Mr. Devesh Krishna, the learned counsel for the petitioners seeks permission to withdraw this quash-petition with the liberty to the petitioners to raise all such plea which are available to them in law at the appropriate stage. 3. The prayer is granted. 4. Accordingly, Cr.M.P. No.713 of 2018 is dismissed, however, with liberty to the petitioners to surrender before the court concerned and make application for grant of bail. If such application is moved within four weeks, a copy thereof duly served upon the learned A.P.P at least three days prior to the date of hearing, the bail application of the petitioners shall be preferably considered on the same day keeping in mind the fact that the petitioners'' complicity in the written report has been alleged at a later stage; the main allegation is against the co-accused-Satyanarayan Singh and Raghunath Singh.
