ORDER : Banumathi, J. Leave granted. 2. The appellant-accused has been convicted under Section 138 of the Negotiable Instruments Act, 1981 and was imposed a fine of Rs. 2,05,000/- (Rupees Two Lakhs Five Thousand) to be paid within a period of three months. 3. Mr. Ragunath, learned counsel appearing for the appellants, and Mr. Mehul Gupta, learned counsel appearing for the respondent-complainant, submit that the respondent-complainant has settled the matter with the appellant-accused and to that effect they have filed a memorandum of understanding stating therein that they have amicably settled the matter. 4. In view of the compromise deed entered into between the parties, the conviction of the appellant is set aside in terms of Section 320(8) Cr.P.C. and the appellant is acquitted of all the charges. 5. Accordingly the appeal is allowed.
