JUDGMENT : NELSON SAILO, J. 1. Heard Mrs. Dinari T. Azyu, the learned counsel for the petitioners. Also heard Ms. Zairemsangpuii, the learned CGC appearing for the respondent Nos. 1 & 2 as well as Mr. C. Zoramchhana, the learned Addl. Advocate General, appearing for the State respondents. 2. Considering the nature of the case and the issues involved, the 2 (two) writ petitions are taken up for disposal at the motion stage itself by way of a common order. 3. In WP(C) No. 33/2019, as many as 51 writ petitioners have approached this Court. It is their case that they possess land settlement passes, issued by the competent authority located at Tuipang/Tipa village within the Siaha District and they have been regularly paying all the land taxes payable towards the same. According to the petitioners, the respondent Nos. 1 & 2 i.e. Border Roads Organization (BRO) have constructed Tuipang-Siatlai-Zawngling-Khopai-Laki village road, which is popularly known as TLL road within the District of Siaha, since the year 2008. That due to the said road construction, the petitioners were asked to vacate their landed properties and they were assured that they will be given adequate compensation as per law. Although the petitioners vacated their lands in view of the assurance given to them by the authorities concerned, despite the destruction of their respective lands, they have only been paid a meager amount in the form of assistance for shifting their dwelling houses and that too, without any basis. In WP(C) No. 34/2019, as many as 17 aggrieved land owners have joined hands to file the writ petition. It is their case that they were issued garden passes by the competent authority for the lands, located at Tipa/Tuipang village with the District of Siaha and they have been paying taxes towards their respective lands regularly. The petitioners contend that their allotted lands are affected by the construction of road from Tuipang-Siatlai-Zawngling-Khopai-Laki village, also popularly known as TLL road within the District of Siaha by the BRO i.e. the respondent Nos. 1 & 2 since the year 2008. The petitioners were asked to vacate their landed properties by the respondent authorities with the assurance that they will be given adequate compensation. Although they vacated their respective lands, no compensation was paid to them except the assistance for shifting their belongings from their respective lands. Azyu, the learned counsel for the petitioners by referring to Annexure-3 in both the writ petitions submits that this Court vide Judgment & Order dated 03.09.2018, passed in WP(C) No. 78/2018, disposed a similar and identical claim by constituting a verification team to verify the land of the petitioners therein and to pay them adequate compensation on the basis of the findings of the verification team. 6. On perusal of the judgment & order dated 03.09.2018, it is seen that the same only covers the case of the present writ petitioners. 7. Mr. C. Zoramchhana, the learned Addl. Advocate General, Mizoram, appearing for the State respondents and Ms. Zairemsangpuii, the learned CGC agree that the writ petitions can be disposed in a similar manner. They however submit that the petitioners may be directed to produce their original land passes as and when verification is conducted. 8. Considering the materials available on record and as well the submissions made by the learned counsels for the rival parties, there appears to be no impediment in disposing the writ petitions in line with the judgment & order dated 03.09.2018, passed in WP(C) No. 78/2018. 9. In view of above, the following verification team is being constituted: (1) The Deputy Commissioner-cum-District Collector, Siaha. (2) The Senior Revenue Officer, Mara Autonomous District Council. (3) The Chief Engineer, Border Road Task Force (BRTF), Project Pushpak GREF, C/o 99 APO or his representatives. (4) The petitioners or their representatives. 10. The verification team shall, within a period of two months from the date of receipt of a certified copy of this order, convene a spot verification of the petitioners' lands. If it is found during the verification that the construction of the road connecting Siatlai-Zawngling-Khopai- Laki Village has been made upon the lands of the petitioners, the Deputy Commissioner-cum-District Collector, Siaha shall send the verification report to all the other respondents. 11. If it is found during the verification that the construction of the road connecting Siatlai-Zawngling-Khopai- Laki Village has been made upon the lands of the petitioners, the Deputy Commissioner-cum-District Collector, Siaha shall send the verification report to all the other respondents. 11. Prior to sending the verification report by the Deputy Commissioner to the other respondents, the respondent No. 4 shall take a decision with regard to whether the land passes of the petitioners are valid and genuine passes, after giving an opportunity of hearing to all the concerned parties. The petitioners shall also produce their original land passes for inspection and verification. If the petitioners land passes are valid and give heritable and transferable rights to the petitioners, the respondents shall thereafter take a decision whether they want to vacate the petitioners' lands on which the road is constructed or acquire the land. If the respondents decide to acquire the land, they shall initiate proceedings for acquisition of the lands of the petitioners under the provisions of the Right of Fair Compensation and Transparency of Land Acquisition, Rehabilitation and Re-settlement Act, 2013 for the land/portion of land it seeks to acquire. 12. The entire exercise for completing the process of acquisition of the petitioners' lands or a portion thereof and the payment of the compensation shall be completed by the respondents within a period of 6 (six) months from the date of sending of the verification report by the Deputy Commissioner to the other respondents. 13. Keeping in mind the fact that 10 years have elapsed from the time the road was constructed, this Court clarifies that in the event it is found in the verification that the road is not constructed upon the lands of the petitioners, but the debris or other factors due to the road construction has only caused some damage to the land and crops of the petitioners, there is no requirement of the respondents to acquire those lands and in that event, the petitioners would have the liberty to make a claim for damages before the Civil Court as per law. 14. With the above observations and directions, writ petitions stands disposed of.
