JUDGMENT Shree Chandrashekhar, J. - This application has been filed seeking modification of the condition that the petitioner shall remain physically present during the trial on each and every date of hearing subject to exceptional circumstances due to which she may not be able to appear in the court. 2. By annexing few medical certificates, the petitioner has pleaded that she who is an old lady is not able to appear on each and every date of hearing. 3. Mr. Ashish Kumar Shekhar, the learned counsel for O.P No. 2 submits that the matter is now perhaps posted for hearing and therefore order dated 30.07.2014 passed in A.B.A No. 1706 of 2014 does not warrant any modification. 4. I think that the aforesaid condition in order dated 30.07.2014 has been misconstrued by the petitioner and now since the trial in C.P. Case No. 185 of 2012 is nearing its competition, the petitioner is not required to appear on each and every date of hearing. She may file appropriate application under section 317 Cr.P.C seeking exemption from her personal appearance except on the date when the matter is posted for judgment. 5. Cr.M.P No. 1208 of 2018 stands disposed of.
