JUDGMENT 1. The petitioner has been made accused in connection with Lohsinghna P.S. Case No. 139 of 2018 registered under Sections 341, 452, 354(D), 354 of the Indian Penal. 2. Heard the parties. 3. Learned counsel for the petitioner submits that allegation against the petitioner is that the petitioner outraged the modesty of the daughter of informant. Learned counsel for the petitioner submits that the allegations against the petitioner are false. The petitioner is ready and willing to cooperate with the investigation of the case and also ready to pay Rs. 5,000/-as ad interim victim compensation to the informant. The petitioner undertakes that he will neither go near the house of the informant, nor disturb or disturb the informant and his family members in any manner and will also not post any message on the social media related to the informant and his daughter during the pendency of this case. It is next submitted the additional ground for prayer of bail is that that the petitioner has to appear in the Graduate Aptitude Test in Engineering, 2019, therefore, the petitioner be released on bail. 4. The learned Addl. P.P. opposes the prayer for bail. 5. Considering the submissions of the counsels and the fact as discussed above, I am of the opinion that this is a fit case where the petitioner, named above, be released on bail. Hence, the court below is directed to release the petitioner, named above, on bail on depositing demand draft Rs. 5,000/- drawn in favour of the informant- Zamil Ashraf as ad interim victim compensation and furnishing bail bond of Rs. 25,000/-(Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Hazaribagh in connection with Lohsinghna P.S. Case No. 139 of 2018 with conditions that he will not go near the house of the informant, not disturb or annoy the informant and his family members in any manner and will also not post any message on the social media related to the informant and his daughter during the pendency of this case, with further conditions: I. the petitioner will co-operate with the investigation of the case, II. the petitioner will appear before the Investigating Officer as and when noticed. III. the petitioner will furnish his mobile phone numbers and copy of Aadhar Card by way of filing affidavit in the court below and will undertake that he will not change his mobile phone numbers during the pendency of this case. 6. If Investigating Officer requires mobile phone numbers of the petitioner, he can make appropriate prayer before the trial court and on such prayer being made the court below will provide mobile number of the petitioner to the Investigating Officer. 7. In case the petitioners deposit the aforesaid amount, the court below is directed to issue notice to the informant- Zamil Ashraf and on his proper identification, the court below shall release the aforesaid amount in favour of the informant
