JUDGMENT : KANWALJIT SINGH AHLUWALIA, J. 1. Instant petition has been preferred under Section 482 Cr.P.C. praying therein that a direction be issued to the Investigating Agency to conduct fair, proper and impartial investigation in a case arising out of impugned F.I.R. No. 241/2016 registered at Police Station Hindaun City District Karauli for offences punishable u/Secs. 302 and 201 I.P.C. 2. The learned counsel appearing for the petitioner has submitted that Brijendra Kumar Arya, the father of the petitioner was murdered. 3. A perusal of the impugned F.I.R. reveals that it is a case of blind murder. 4. Counsel appearing for the petitioner has contended that since there is no direct evidence, it is a case of circumstantial evidence. Counsel has further contended that the Investigating Agency has filed report of investigation by nominating two persons as accused. Counsel has pleaded that number of other persons were also involved as accused and the Investigating Agency, inspite of having evidence against other persons who have committed offence, is not proceedings against them. Counsel has further pleaded that qua other accused, the investigation has been kept pending under Section 173 (8) Cr.P.C. Counsel has stated that he is having no clue as to who were the other persons involved in the alleged offence, but he has suspicion. Lastly, Counsel has submitted that as per his information, it is recorded in the Police Diary that other persons were also involved. 5. After hearing Ld. counsel appearing for the petitioner and Ld. Public Prosecutor appearing for the State, the present petition is disposed of, by issuing a direction to the Investigating Officer to conclude the investigation, which has been kept pending under Section 173(8) Cr.P.C, qua the accused not sent for trial. The Investigating Officer shall do the needful within a period of two months from the date of receipt of certified copy of this order.
