ORDER : 1. This Criminal Revision Case is filed under Sections 397 and 401 of the Code of Criminal Procedure aggrieved by the order dated 10.01.2020 passed in Crl.MP.No.131 of 2020 in C.C.No.117 of 2015 on the file of the IV Additional Chief Metropolitan Magistrate, Hyderabad, in rejecting interim custody of the passport to the revision petitioner bearing No.T9953563 for a period of six months. 2. Learned counsel for the revision petitioner contended that the learned Magistrate ought to have taken into consideration the fact that the revision petitioner has nothing to do with the alleged criminal case and the revision petitioner is intending to travel on a pilgrimage called ‘Umrah’ according to Islamic traditions, rites and customs. It is further contended that the learned Magistrate dismissed the petition without any sufficient and cogent reasons. 3. Considering the facts and circumstances of the case, the order dated 10.01.2020 passed in Crl.MP.No.131 of 2020 in C.C.No.117 of 2015 on the file of the IV Additional Chief Metropolitan Magistrate, Hyderabad, is modified and the revision petitioner is granted interim custody of passport bearing No.T9953563 for two months i.e. from 07.02.2020 to 31.03.2020 on her furnishing a personal bond for a sum of Rs.1,00,000/- (Rupees one lakh only) with one surety for a like sum to the satisfaction of the Court below. The revision petitioner shall surrender the said passport positively by 06.04.2020 before the Court concerned. 4. With the above modification, this Criminal Petition is disposed of. 5. Miscellaneous applications, if any, pending shall stand closed.
