JUDGMENT : Mohammad Yaqoob Mir, J. In compliance to the order dated 21.12.2018, Commissioner and Secretary to the Government of Meghalaya, Forest and Environment Department, Shillong has filed an affidavit on 19.02.2019, stating therein that requisite funds have been released for repair works to be carried out pertaining to the road starting from Hatisia to Helipad (old) at Balpakram Plateau work is to be commenced once the proposal is sanctioned by the Empowered Sanctioning Committee. There is element of uncertainty which is required to be removed by filing a fresh affidavit wherein it shall be stated from which date process for repair works vis-a-vis the said road will be started. Furthermore, Commissioner and Secretary shall pursue so as to get the proposal sanction by the Empowered Sanctioning Committee at the earliest. 2. In compliance to the order dated 21.12.2018, the Chief Engineer PWD (Roads) National Highway, Meghalaya, Shillong has filed an affidavit stating therein that, (i) The damaged portion of the road starting from Wahkdait to Dawki for 7 Km, resurfacing work has been completed on 31.12.2018; (ii) Resurfacing work for 18 Km of the damaged portion of the road starting from 7th mile to Pynursla has also been completed on 31.12.2018 and; (iii) It is further stated that in addition to 7 Km from Wahkdait to Dawki after noticing severe damage in the portion beyond Dawki i.e. from junction of Dawki Amlarem Jowai road and Shillong- Tamabil Road for 1 km upto International Border at Tamabil, rebuilding of the pavement by providing Water Bound Macadam (WBM) has been initiated and resurfacing work is likely to be taken up soon and shall be completed by 15.03.2019 with the assistant of police for traffic management. 3. Regarding this affidavit learned Amicus Curiae would submit that he be given time to ascertain about the present position of the said road. He shall be at liberty to file his response by or before the next date. 4. List again after two weeks.
