JUDGMENT Shree Chandrashekhar, J. - The petitioners seek quashing of the entire criminal proceeding arising out of Bishnugarh P.S.Case No.125(08) of 2017 corresponding to G.R. No.2279 of 2017 which has been registered by virtue of an order of the Magistrate passed in the Complaint Case No.1012 of 2017 for the offences punishable under section 447, 341, 342, 323, 504, 379/34 IPC. 2. Mrs. Bakshi Vibha, the learned counsel for the petitioners submits that on fictitious facts an incident has been created by the complainant projecting an illusion as if the petitioners have committed the offence punishable under section 447, 341, 342, 323, 504, 379/34 IPC. It is further submitted that even after about 1 1/2 years of registration of the First Information Report no material has been collected against the accused persons. 3. However, after arguing for sometime faced with the difficulty that final report on investigation is still awaited Mrs. Bakshi Vibha, the learned counsel for the petitioners seeks permission to withdraw this quash-petition with liberty to the petitioners to raise all such plea which are available to them in law. 4. In view of the limited prayer made on behalf of the petitioners, without observing on merits of the plea raised on behalf of the petitioners, Cr.M.P. No.870 of 2018 stands withdrawn with liberty to the petitioners, as prayed for. It is made clear that withdrawal of this quash-petition shall not prejudice the petitioners in any other proceeding arising out of Bishnugarh P.S.Case No.125(08) of 2017.
