JUDGMENT 1. Heard on the application for temporary suspension of sentences. Perused the material available on record. 2. The convict applicant Keshar Singh is present in person as he has been released on emergent parole by the District Collector, Nagaur owing to the death of his wife Smt. Santosh Kanwar who expired on 29.01.2019. The convict applicant submits that he has been charged with the murder of his own brother and thus, his family members are not on good terms with him. He prays for interim bail for a period of 45 days so that he can settle his children in a safe and secure atmosphere. 3. Learned Public Prosecutor affirms the fact that the convict has been granted emergent parole by the District Collector owing to the death of his wife Smt. Santosh Kanwar which, as per the death certificate placed on record, took place on 29.01.2019. 4. In view of the above facts and circumstances of the case and taking a humanitarian view, we feel inclined to accept this application for temporary suspension of sentences and direct release of the applicant appellant on interim bail for a period of 45 days from the date on which the period of his emergent parole comes to an end. 5. Accordingly, the instant application for temporary suspension of sentences filed under Section 389 Cr.P.C. is allowed and it is ordered that the sentences passed by the learned Additional Sessions Judge, Parbatsar, District Nagaur, vide judgment dated 05.08.2015 in Sessions Case No. 64/2011 (67/2014) against the appellant-applicant Keshar Singh S/o Sh. Bheru Singh, shall remain temporarily suspended and he shall be released on interim bail for a period of 45 days from the date on which the period of his emergent parole comes to an end, provided he executes a personal bond in the sum of Rs. 80,000/- with two sureties of Rs. 40,000/- each to the satisfaction of the learned trial Judge. The Superintendent, Central Jail, Ajmer shall give the date of surrender to the appellant as per the date on which he is released from custody.
