JUDGMENT 1. This writ petition pertains to the action of the Bank in pursuance to SARFAESI Act, wherein notice under Section 13 (4) of the SARFAESI Act has been issued on 23.08.2018. 2. Learned counsel for the respondent-Bank has raised objection by referring to the judgment of the Supreme Court reported in (2010) 8 SCC 110 (United Bank of India vs. Satyawati Tondon & Ors.) and has submitted that remedy is available to the petitioner under Section 17(1) of the SARFAESI Act. 3. Learned counsel for the petitioner seeks permission for withdrawal of the writ petition with liberty to pursue the matter before the appropriate authority/Forum. 4. In view thereof, the writ petition is dismissed as withdrawn with the liberty aforesaid. (Sujit Narayan Prasad, J.) Saket/-
