ORDER 1. Heard learned counsel for the parties. 2. Delay condoned. 3. Leave granted. 4. The suit was decided in favour of the appellant and the appeal has also been now dismissed. In the facts and circumstances, we set aside the punishment of simple imprisonment for a period of two months imposed on the appellant and instead direct the appellant to pay an amount of Rs.50,000/- (Rupees Fifty Thousand only) as fine that shall be paid to respondent as costs, within a period of four weeks, failing which the impugned order regarding imprisonment shall stand. 5. Subject to above, the appeal is disposed of with the aforesaid modification in the impugned order. 6. Pending application, if any, stands disposed of.
