JUDGMENT Sujit Narayan Prasad, J. - The writ petition is for issuance of direction upon the respondent-State authorities to restrain respondent no.7 in carrying out the mining operation on the raiyat land of the petitioner pertaining to Khata no.347/49, Plot No.2129/2066/559 admeasuring a total area of 7.42 acres situated at Mouza Chando, P.S-Chainpur, P.S No.179, District Palamau.. 2. It is the case of the petitioner that he has made serious objection against the mining work being operated in the land pertaining to the petitioner for which he has filed an application before the Circle Officer concerned, but no decision has been taken, therefore, this writ petition has been filed. 3. He further submits that he may be allowed to approach before the Deputy Commissioner along with documents showing title over the land in question. 4. Ms. Srishti Sinha, A.C to A.G appearing for the respondents has submitted by rebutting the stand taken by the petitioner, however, she has fairly submitted that the authority concerned will look into the matter and take appropriate decision after hearing the petitioner as well as respondent no.7. 5. Having heard learned counsel for the parties the writ petition is being disposed of at this stage without entering into the merit by giving liberty to the petitioner to file representation before the Deputy Commissioner, Palamau along with the document in support of title of the land in question within two weeks of the receipt of copy of the order, who in turn thereof shall hear the petitioner as also the respondent no.7 and to take decision within six weeks after receipt of the representation in accordance with law. 6. The writ petition is accordingly disposed of.
