JUDGMENT 1. The petitioners are aggrieved of the orders dated 17.09.2018 (Annex.8) and 26.12.2018 (Annex.9) issued by the Director (Public Health), Medical Health Services, Rajasthan, Jaipur and Chief Medical & Health Officer, Nagaur respectively regarding engagement of various employees for Mukhyamantri Nishulk Davai Yojna and Mukhyamantri Nishulk Janch Yojna. 2. It is contended that the action proposed to be taken by the Chief Medical & Health Officer and other block Chief Medical Officers etc. pursuant to the orders dated 17.09.2018 and 26.12.2018 is ex facie contrary to the judgment of this Court in Pankaj Kumar Upadhyay & Ors. v. State of Rajasthan & Ors.: S.B. Civil Wrti Petition No. 953/2017, decided on 20.03.2017. The operative portion whereof reads as under :- "In view of the above, the present petitions deserve to be allowed. The impugned orders dated 16.12.2016 and 21.12.2016 are set aside qua the petitioners, vide which they are being sought to be replaced or their services are being extended only upon being engaged through placement agency. The respondents shall continue to utilize the services of the petitioners as Computer Operators with machine on contractual basis and shall not replace them by another set of contractual employees either through direct appointment or placement agency. The services of the petitioners shall be renewed periodically till requirement of the services subsists and their services are found to be satisfactory or till the regular appointments are made." 3. Looking to the issues raised by the petitioners and finding that apparently the action of the respondents, is contrary to the directions issued in the case of Pankaj Kumar Upadhyay (supra), a copy of the writ petition be served on Mr. Manish Vyas, learned AAG, who is directed to put in appearance on behalf of the respondents, who prays time to complete his instructions in the matter in light of the observations made herein-before. 4.
