JUDGMENT 1. Heard learned counsel for the petitioner as well as learned Public Prosecutor and also perused the material on record. 2. The petitioner has been arrested in FIR No. 46/2016 of Police Station Banar, District Jodhpur for the offences punishable under Sections 365, 364-A and 120-B of IPC. He has preferred this interim bail application under Section 439 Cr.P.C. 3. Learned counsel for the petitioner has submitted that father of petitioner died on 27.12.2018 and for the purpose of performing ritual, the petitioner be released on temporary bail for a period of one week. A copy of the death certificate is also annexed with the petition. 4. Learned Public Prosecutor as well as counsel for the complainant have opposed the bail application. 5. Having regard to the totality of the facts and circumstances of the case, without expressing any opinion on the merits of the case, I deem it just and proper to grant interim bail to the accused petitioner for a period of seven days. The petitioner be released for a period of seven days. 6. Accordingly, this interim bail application filed under Section 439 Cr.P.C. is allowed and it is directed that petitioner Raju Singh @ Rajendra Singh S/o Late Gajje Singh shall be released on bail in connection with FIR No. 46/2016 of Police Station Banar, District Jodhpur provided he furnishes a personal bond of Rs. 2 lacs along with two sureties of Rs. 1 lac each to the satisfaction of the learned Additional Sessions Judge No. 4, Jodhpur Metro. The petitioner shall surrender before the Superintendent of Central Jail, Jodhpur after completion of seven days from the date of his actual release.
