JUDGMENT : 1. Disobedience of the order dated 25.06.2018 passed in WP(C) No. 190 of 2018 is alleged hence, the instant motion for initiating contempt proceedings. 2. In the order dated 25.06.2018, it is noticed that the parties have reached to an agreement in terms whereof, the petitioner had to withdraw all cases against the Government subject to two conditions; (i) that the petitioner will clear her dues whatever outstanding, and (ii) on clearance of the dues, the weighbridge in question will be restored to her. It was directed that the petitioner on depositing all her dues thereafter, within two weeks, the weighbridge (subject matter) shall be restored to her with a rider that the petitioner will abide by the terms and conditions whatever applicable. 3. According to learned counsel for the petitioner, the amount which as per the assertion of the respondent, was due is Rs. 48,90,000/- same was deposited by her but weighbridge was not restored. 4. The respondent Commissioner of Transport has filed an affidavit wherein, it is clarified that due to some error, Rs. 48,90,000/- was shown outstanding when in fact, Rs. 1,06,64,376/- was outstanding. That being so, the petitioner submits that she will deposit the balance amount of Rs. 57,74,376/-, when the petitioner deposits the same, then condition no. (ii) has to be complied with by the respondents. 5. Learned counsel for the petitioner would submit that the error which had crept in was due to the lapse of the respondent, petitioner will deposit the amount but however, two weeks time is required for the same. She shall be free to deposit the amount within two weeks from today thereafter, the respondent shall take steps for ensuring complete compliance of the judgment. 6. Contempt proceedings do not survive for any further consideration are, accordingly closed. 7. Disposed of as above.
