ORDER Re. I.A. No. 08 of 2019. Interlocutory Application no. 08 of 2019 filed on behalf of appellant ( kept at Flag-A) has been pressed today. 2. Heard learned counsel for the appellant and the learned counsel for the respondents. 3. The instant interlocutory application has been filed for restraining respondents specially respondent no.3, Smt. Indu Devi who is purchaser from respondent no.1 Smt. Sushila Devi from alienating, encumbering or changing the nature of suit property as purchased by Indu Devi on 31.10.2000 over an area of 5 katha 12 Dhur 16 dhurkis. It has further been submitted that said Indu Devi is trying to raise some construction over the land in question. 4. Learned counsel for the respondents has submitted that any action of the respondent -purchaser during pendency of this appeal will be hit by principle of lis pendens. He further submits that at present appellant has neither prima facie case nor balance of convenience in his favour. 5. This Court finds that during pendency of this appeal various transactions have been made as mentioned in the Interlocutory petition. Therefore, this Court is not inclined to pass any order of status quo. This Court, however, observe that any construction which has been made or is likely to be made shall be at the risk of purchaser and if the appellant succeeds in appeal, the respondent will not claim any compensation from the appellant. 6. I.A. No. 08 of 2019 stands disposed of.
