JUDGMENT Mr. Sudhir Mittal, J. (Oral):- The petitioner seeks regular bail in case FIR No.112 dated 19.6.2018, registered at Police Station Bagha Purana, District Moga, under Section 22 of the NDPS Act, 1985. 2. Learned counsel for the petitioner submits that the petitioner has been in custody for more than 06 months. The trial is not likely to be concluded at an early date as examination of PWs has not yet started. The petitioner does not have any criminal antecedents, thus, he may be released on regular bail. 3. Custody certificate dated 26.2.2019, by way of affidavit of Sh. L.K. Kohli, PPS, Deputy Superintendent, Central Prison, Faridkot, has been filed by the learned State counsel in Court and the same is taken on record. According to this certificate, the petitioner has undergone actual custody of 06 months and 13 days and there is no criminal case pending or decided against him. 4. The factual submissions made by counsel for the petitioner have not been controverted by learned State counsel. 5. Keeping in view the facts and circumstances of this case, I deem it appropriate to allow this petition. Accordingly, the petition is allowed and petitioner-Kaku Kumar @ Kaka Kumar @ Kaku Ram @ Kaku Singh, is ordered to be released on bail on his furnishing bail and surety bonds to the satisfaction of the trial Court concerned.
