JUDGMENT : TARLOK SINGH CHAUHAN, J. 1. The impugned order passed by the learned Magistrate on 01.02.2019 reads as under:- "One PW namely Smt. Jasvinder Kaur present and cross- examined today. During her cross-examination learned counsel appearing for the accused has asked a question as to whether the meaning of "second story" and "Dusari Manjil" are one and the same which is appearing in the examination-in-chief of this witness. This court found that this question is highly irrelevant as the counsel appearing for the accused could not explain relevancy of this question to this court. In these circumstances, the cross-examination of this witness namely Smt. Jasvinder Kaur is closed by order of court. Let Pws at Sr. No. 2 & 4 be called for their examination for 11.04.2019." 2. I am at failure to understand how the Court could have closed the right of cross-examination of the witness merely on the basis of a question, which according to it, was highly irrelevant. At the best, the learned Magistrate could have discarded the question, but under no circumstances, could the right of the petitioners of cross-examination of the witness have been closed, that too by order of the Court. 3. Accordingly, the impugned order dated 01.02.2019 is set aside. The petitioners are permitted to cross examine witness Smt. Jasvinder Kaur. As regards, the relevancy of the question as referred in the impugned order, the learned Magistrate shall pass a reasoned order as to how the question is irrelevant. 4. The petition stands disposed of in the aforesaid terms, so also all the pending applications.
