JUDGMENT Sujit Narayan Prasad, J. - This writ petition is under Article 226 of the Constitution of India wherein the order dated 30.07.2018 passed by Sub-Divisional Officer, Mahagama, Godda in Revenue Misc. Case No.06/2018 has been assailed whereby and whereunder the Circle Officer, Mehrama has been directed to provide all administrative support to the private respondent No.4 in order to allow him to cultivate an area of 70 Bigha, 10 Katha and 11 Dhur in Jamabandi No.20 and 25, Thana No.315, Mouza-Mahuadih, District Godda. 2. It is evident from the material available on record that for the same suit of land, a title suit has been filed being Title Suit No.46 of 2008. 3. Mr. Mrinal Kanti Roy, learned counsel arguing for the petitioner has submitted that in the aforesaid title suit, a petition under Order 39 Rule 1 & 2 was filed but the same has been rejected against which the appropriate application has been filed assailing the aforesaid order being W.P.(C) No.3522 of 2014. 4. This Court after considering the factual aspect and taking into consideration the fact that the proceeding for the same suit for declaration of right and title is lying before the competent court of civil jurisdiction being Title Suit No.46 of 2008 and the order has been passed in this case directing the Circle Officer to take steps by allowing him to cultivate the aforesaid area which is subject matter of suit, therefore, it would not be proper and appropriate for this Court to exercise the extraordinary jurisdiction conferred to this Court under Article 226 of the Constitution of India. 5. In view thereof, the writ petition is dismissed.
